The website www.erinvsdesign.com (the “Website”) is owned and operated by Erin
VanderSluis Design Inc. (referred to as “Erinvsdesign”, “we”, “our”, “us” or the ”Company”). Erinvsdesign provides services to you subject to the following Terms and Conditions.

These Terms and Conditions shall be the only applicable conditions excluding any other, unless explicitly agreed otherwise in writing between the parties. Users of the Website are deemed to have read, understand and agree to the applicable Terms and
Conditions. Erinvsdesign reserves the right to amend and change these Terms and
Conditions. The amended Terms and Conditions will be immediately applicable when they are uploaded on the Website.

PRICES

All prices listed on our Website are in Canadian Dollars ($CAD). The prices displayed do not include taxes. Applicable taxes (GST, HST, QST, etc.) must be added according to the customer’s province. Depending on the total amount of the order and the delivery address, delivery charges may not be included.

PAYMENT
We accept payment via electronic funds transfer (“e-transfer”) or cheque. Credit card
payments will not be accepted. Payments are due in accordance with the terms set out in the applicable invoice, unless otherwise agreed to in writing by the parties. The client shall be responsible for ensuring that all payments are made in full and on time.
Services We primarily provide interior and exterior design consultation services. Consultations may be provided virtually or in person. On occasion, we may assist clients by recommending specific products or sources, such as by sharing product links or by selecting items together locally. We do not purchase or order furniture, décor, materials, or other items on behalf of clients. Our role is advisory only, and all purchases are made directly by the client. Clients are paying solely for the time and expertise provided during the consultation, whether virtual or in person.
Erinvsdesign does not warrant the quality, condition, safety, or suitability of any such
products and shall not be liable for any defects, damages, or delays related to them.
Erinvsdesign is not responsible for any loss, damage, or delay that occurs during the
shipping or delivery. All claims for damage incurred during shipping must be made directly through the carrier.

HYPERLINKS
Our Website may contain links to other websites. Erinvsdesign has no influence on the
privacy policy of these third parties and will not be responsible for the content associated
with these websites.

COOKIES
Our website may use cookies, web beacons, and similar technologies to enhance your

If you believe that the images or products on this Website infringe your or a third party’s rights, please immediately inform Erinvsdesign so we can assess the alleged infringement and remove the relevant images or products if required. Erinvsdesign cannot be held responsible for any infringement by its commercial partners or by the users of the Website.

DISPUTES
Any controversy, claim or dispute arising out of or relating to these Terms and Conditions, your use of the Erinvsdesign Website or the relationship which results from these Terms and Conditions, including without limitation, the performance, breach, enforcement, existence or validity of the matters provided for in these Terms and Conditions which cannot be amicably resolved, even if only one of the parties declares that there is a difference (collectively, a "Claim"), will be referred to and finally settled (to the exclusion of the courts) by private and confidential binding arbitration before a single arbitrator held in Ontario, and shall be governed by and construed in accordance with the laws of the Province of Ontario, including the Arbitration Act, 1991, S.O. 1991, c. 17, and any other applicable statutes. The arbitrator shall be a person who is legally trained and who has experience in the information technology field in Canada and is independent of either party. Any such Claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any
claim, controversy or dispute of any other party. You agree to waive any right you may have to commence or participate in any class action against us related to any Claim and, where applicable, you also agree to opt out of any class proceedings against us. Notwithstanding the foregoing, we reserve the right to pursue the protection of intellectual property rights and confidential information through injunctive or other equitable relief through the courts.

INDEMNITY
You waive, release, discharge and relinquish any and all claims that you have now or may have against Erinvsdesign which are connected with, arise out of, relate to or are incidental to the use of the Website. You agree to indemnify and to keep indemnified Erinvsdesign and hold harmless from and against any and all claims, loss, damage, taxes, liability and/or expense that may be incurred by Erinvsdesign arising out of or in connection with the use of the Website.

SITE POLICIES, MODIFICATIONS AND SEVERABILITY

ENTIRE AGREEMENT
These Terms and Conditions, together with out current Website prices, delivery details,
contact details and privacy policy, set out the whole of our agreement relating to the supply of the goods to you by us. Nothing said by any salesperson on our behalf should be understood as a variation of these terms and conditions or as an authorized representation about the nature or quality of any goods offered for sale by us. The company accepts responsibility under these Terms and Conditions for its commitment to you.
